Patrick Whitt, executive director of the Presidential Council of Advisors on Digital Assets, set September 15 as the de facto deadline for passage of the CLARITY Act, saying bluntly, "if they can't agree by then, they will never agree." He said Congress has spent years debating a digital assets framework and that the Senate has been actively negotiating the CLARITY Act since last summer. Whitt accused Senate minority leader Chuck Schumer and what he called "pro-crypto Democrats" of trying to block even a simple procedural vote before the recess, repeatedly seeking delays instead of letting the process move forward.
The deadline was not pulled out of thin air: Majority Leader John Thune has already filed a motion to invoke cloture on the bill, thereby setting a specific procedural date. The Senate will return on September 14, and the cloture vote is formally expected to occur on September 15. So, Whitt is not merely expressing a wish but describing a legally anchored timetable. Republicans will need the support of at least 7 Democrats, in addition to their own 53 votes, to reach the 60?vote threshold.
Democrats' position looks different from how the White House presents it. The formal reasons for delay remain the same issues that have dogged the bill all year: whether law enforcement tools are sufficient and concerns made especially acute after a recent leak about a possible tax benefit for Trump. Notably, the House already approved the bill's predecessor, H.R. 3633, by a 294–134 vote in July 2025, when 78 Democrats joined Republicans — showing that bipartisan support is achievable in principle; the question is the specific terms of the Senate version.
